1. Application

These Terms and Conditions govern all contractual relationships between AvioTest (the provider) and you as a private consumer within the meaning of § 13 BGB.

We do not recognize provisions that contradict or deviate from these Terms and Conditions unless expressly agreed to in writing.

If the contracting party is acting in a commercial capacity within the meaning of § 14 BGB, a separate agreement may apply. In the absence of such an agreement, these Terms and Conditions shall apply alternatively.

2. Conclusion of Contract

By placing an order, you make an offer to conclude a purchase contract for the digital product. The contract is concluded upon confirmation of your order or provision of access to the software/service.

3. Right of Revocation and Consequences

You have the right to revoke the contract within 14 days without giving reasons. The revocation period begins on the day you (or a third party authorized by you) receive access to the software.

To comply with the period, it is sufficient to send your declaration of revocation within the 14 days (e.g., by email).

Important:

The right of revocation lapses once the software has been unsealed or activated (e.g., by login, download, or installation).

In the event of a valid revocation, all payments received will be refunded promptly, at the latest within 14 days from receipt of the revocation. Refunds will be made using the same payment method used for the original transaction unless otherwise agreed.

4. Delivery

Access is provided automatically by the system after successful payment is received.

5. Payments

Payments can be made only within the apps using the methods offered there (e.g., App Store, Google Play).

Access to the software is granted only after full payment has been received.

6. Reservation of Rights and Licenses

All digital products remain the intellectual property of AvioTest until full payment is received.

Use of the software is subject to the AvioTest End User License Agreement (EULA). Any third-party components distributed through AvioTest are subject to their own license terms.

7. Material Defects

In the case of defects in the digital product, statutory warranty rights under applicable law apply.
